Victoria's Insurance Monopoly Proposal: Implications for Builders

Understanding the Potential Impact of the VBA's Insurance Control

Victoria's Insurance Monopoly Proposal: Implications for Builders?w=400

The Victorian Government has introduced the Building Legislation Amendment (Buyer Protections) Bill 2025, aiming to centralise domestic building insurance under the Victorian Building Authority (VBA).
This move would eliminate competition, requiring builders to obtain coverage exclusively from the VBA.

Key concerns include:

  • State-Controlled Insurance Monopoly: Builders would lose access to competitive insurance options, relying solely on a government-run insurer.
  • Escalation of Contractual Disputes: The first-resort model could turn standard disputes into insurance claims, increasing costs.
  • Limited Rights to Challenge Rectification Orders: Builders might be compelled to rectify work or pay compensation with limited avenues for dispute.
  • Higher Insurance Costs: First-resort models often lead to increased administrative costs and premiums.
  • Increased Red Tape and Delays: Centralising insurance could result in longer claim processing times and regulatory bottlenecks.

Industry stakeholders are urging the government to pause the legislation and engage in genuine consultation to develop a fairer solution that protects consumers without penalising reputable builders.
